Applicability

As a German company, data protection is of special importance to us. This is why we place great value on respecting your privacy, especially by collecting, processing, using and protecting your personal data in accordance with the law. This Privacy Policy will inform you about the type, scope and purposes for which we process personal data for our online and offline offer.

This Privacy Policy will inform our users about the type, scope and purposes for which the controller, Herchenbach Industrial Buildings GmbH, Löhestrasse 6, 53773 Hennef, Germany, datenschutz@herchenbach.de +49 2242 96996 0, collects personal data on this website (hereafter "offer").

The legal basis for data protection can be found in the German Federal Data Protection Act [Bundesdatenschutzgesetz, BDSG], the German Telemedia Act [Telemediengesetz, TMG] and the General Data Protection Regulation (GDPR). If the data that is processed is personal data, the legal basis for its processing is Art. 6(1)(b), Art. 6(1)(c), or Art. 6(1)(f) of the GDPR.

Access data / server log files

The provider (or the provider's web space provider) collects data on every access to the offer (so-called server log files). Access data includes:

Name of the accessed website, file, time and date of access, volume of data transferred, successful access notification, browser type and version, operating system of the user, referrer URL (last visited page), IP address and the requesting provider.

The provider only uses protocol data for statistical assessments to operate, optimise and secure the offer. However, the provider reserves the right to subsequently review the protocol data in case of concrete indications for legitimate suspicions of unlawful use.

Treatment of personal data

Personal data means information through which a person may be identified, i.e. that can be traced to a specific person. This includes one's name, email address and telephone number but also data on one's preferences, hobbies, memberships or viewed websites.

Personal data are only collected, used and transferred by the provider if permitted by law or if users consent to the data collection.

Contact

When contacting the provider (e.g. by contact form, call-back form or email), the information of the user will be saved to process the request and for any follow-up questions. The user may revoke this consent for data storage at any time with future effect.

Comment subscriptions

Users may subscribe to follow-up comments. Users will receive a confirmation email to review whether they are the owner of the provided email address. Users may unsubscribe from active comment subscriptions at any time. The confirmation email will also include notices.

Newsletter

We use our newsletter to inform you about us and our offers.

If you would like to receive our newsletter, we will need a valid email address and information that allows us to verify that you are the owner of the provided email address or that its owner agreed to the receipt of our newsletter. Further data will not be collected. This data is only used to send our newsletter and will not be provided to third parties.

When users subscribe to our newsletter, we save their IP address and the date of subscription in case a third party abuses an email address and subscribes to our newsletter without the knowledge of the owner of the email address.

You may withdraw your consent for the storage of data, your email address and its use for the sending of our newsletter. Consent may be withdrawn through a link in the newsletters, through your profile section or by notification to the above-stated contact options.

Inclusion of third-party services and contents

Our online offer may include third-party contents, e.g. videos of YouTube, maps of Google Maps, RSS feeds or graphics of other websites. This requires the providers of these contents (hereafter referred to as "third-party providers") to receive the user’s IP address. Without an IP address, contents cannot be transmitted to the user's browser. An IP address is therefore necessary for displaying these contents. We strive to only use contents whose providers merely use IP addresses to provide the respective contents. However, we cannot influence whether the third-party provider saves the IP address for, e.g. statistical purposes. We will notify our users accordingly to the best of our knowledge.

Cookies

Cookies are small files that allow specific information related to the device to be saved on users' accessing devices (PCs, smartphones, etc). Cookies serve both the user-friendliness of websites and thereby their users (e.g. by saving login data) and also allow statistical data on website use to be collected and analysed to improve the offer. Users may control the use of cookies. Most browsers include options to restrict or completely prevent the saving of cookies. However please note that use and especially the ease of comfort of the use of our website will be restricted without cookies.

Our use of cookies is based on Art. 6(1)(f) of the General Data Protection Regulation: Processing is performed to improve the functionality of our website and is therefore required to safeguard our legitimate interests.

You may manage several companies' online display cookies through the American website http://www.aboutads.info/choices/ or the EU website http://www.youronlinechoices.com/uk/your-ad-choices/.

Registration function

Data entered as part of the registration will be used for utilising our offer. Users may receive information relevant to the offer or their registration, e.g. changes to the offer scope or technical circumstances, by email. The data that will be collected can be found on the input mask during registration.

Google Analytics

We use Google Analytics, a web analysis service of Google LLC ("Google") on the basis of our legitimate interests (i.e. interest in the analysis, optimisation and economic operation of our online offer in the sense of Art. 6(1)(f) of the General Data Protection Regulation). The information generated by the cookie on use of the online offer is generally transmitted to a Google server in the US where it is saved.

Google is certified under the Privacy Shield agreement and therefore guarantees adherence to European Union data protection laws https://www.privacyshield.gov/participant?id=a2zt000000001L5AAI&status=Active.

Google will use this information to assess use of this website by our users, to compile reports about website activity and to perform additional services related to use of the website and the Internet for us. The processed data may be used to create pseudonymous usage profiles.

We activate IP anonymisation when using Google Analytics. This means that IP addresses will be shortened by Google within a Member state of the European Union or in another state party to the European Economic Area Agreement. Only in exceptions will a full IP address be transferred to a Google server in the US and shortened there.

We use Google Analytics to only display advertisements of advertising services of Google and of its partners to users who have shown interest in our online offer or who display certain characteristics (e.g. interest in certain topics or products determined by which websites are visited) that we transmit to Google (so-called "remarketing" or "Google Analytics audiences"). We also use remarketing audiences to ensure that our advertisements correspond to the potential interests of our users.

The IP address transmitted by the user's browser will not be merged with other Google data. Users may prevent cookies from being saved through browser settings accordingly. Furthermore, users may prevent the collection of cookie-generated data on their use of the website and the processing of this data by Google by downloading and installing the browser plugin provided at the following link: https://tools.google.com/dlpage/gaoptout?hl=en-GB.

Alternatively, you may opt out of Google Analytics by activating this link.

For more information about Google's use of data, your settings and objection possibilities can be found on Google's websites: https://policies.google.com/technologies/partner-sites?hl=en-GB ("How Google uses information from sites or apps that use our services"), adssettings.google.com ("use of data for advertising purposes"), ("Ads personalisation").

Google re/marketing services

We use the marketing and remarketing services ("Google marketing services") of Google LLC, 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA, ("Google") on the basis of our legitimate interests (i.e. interest in the analysis, optimisation and economic operation of our online offer in the sense of Art. 6(1)(f) of the General Data Protection Regulation).

Google is certified under the Privacy Shield agreement and therefore guarantees adherence to European Union data protection laws (https://www.privacyshield.gov/participant?id=a2zt000000001L5AAI&status=Active).

Google marketing services allow us to display more targeted advertisements for and on our website to ensure that our advertisements correspond to the potential interests of our users. For example, if advertisements for products in which a user showed interest on other websites are displayed to this user, this is called "remarketing". For these purposes, a code will be executed directly by Google when our website and other websites are opened that activated Google marketing services and so-called (re)marketing tags (invisible graphics or code, also referred to as a "pixel") will be included on the website. This allows an individual cookie, i.e. a small text file (comparable technologies may also be used instead of cookies) to be saved on the device of the user. These cookies may be installed by various domains including google.com, doubleclick.net, invitemedia.com, admeld.com, googlesyndication.com and googleadservices.com. This file will record which websites the user visits, which contents he is interested in and on which offers he clicks as well as technical information on the user's browser and operating system, referring websites, visiting times and other information about use of the online offer. The user's IP address will also be collected, though the IP address will be shortened by Google within a Member state of the European Union or in another state party to the European Economic Area Agreement and a full IP address will only be transferred to a Google server in the US and shortened there in exceptions when using Google Analytics. The IP address will not be merged with other Google data on the user. Google may link the above-stated information to information from other sources. If the user subsequently visits other websites, advertisements based on the user's interests may be displayed.

User data is processed pseudonymously by Google marketing services. This means that Google does not save or process, e.g. the name or email address of a user, but will process the data in relation to the cookie through pseudonymous user profiles. From Google's perspective, these advertisements are not managed and displayed for specifically identified persons but for the cookie holder irrespective of who the cookie holder is. This does not apply if a user expressly consents to have Google process the data without this pseudonymisation. The information collected on the user by Google marketing services will be transmitted to Google and saved on Google's servers in the US.

The Google marketing services used by us include the online advertising programme "Google AdWords". Google AdWords provides a different "conversion cookie" to each AdWords customer. Cookies therefore cannot be traced through the websites of AdWords customers. The information obtained through the cookie is used to prepare conversion statistics for AdWords customers who choose conversion tracking. AdWords customers will learn the total number of users who clicked on an advertisement and were transferred to a page that features a conversion tracking tag. However, they receive no information that would allow users to be personally identified.

Furthermore, we use "Google Tag Manager" to manage and feature Google analysis and marketing services on our website.

For more information about Google's use of data for marketing purposes, please see policies.google.com/technologies/ads. For Google's Privacy Policy, please see

https://policies.google.com/privacy?hl=en-GB.

If you would like to refuse interest-based advertising from Google marketing services, you may use the settings and opt-out options provided by Google: http://www.google.com/ads/preferences.

Google AdSense

This offer uses Google AdSense, a service for integrating advertisement displays of Google Inc. ("Google"). Google AdSense uses so-called "cookies", text files saved on users' computers, that allow use of the website to be analysed. Google AdSense also uses so-called web beacons (invisible graphics) that allow information such as visitor traffic on the pages of the offer to be assessed.

The information on use of this website (including user IP addresses) generated by cookies and web beacons and the delivery of advertising formats will be transmitted to a Google server in the US where they will be saved. Google may transfer this information to its contract partners. However, Google will not merge your IP address with other data saved on you.

Users may prevent the installation of cookies through according browser settings. However, the provider notes that doing so may prevent users from fully using every function of this offer. By using this website, users agree to have the data collected on them processed by Google in the manner and for the purposes previously described.

YouTube

This offer uses YouTube LLC, 901 Cherry Avenue, San Bruno, CA 94066, USA, represented by Google Inc. to embed videos. Normally your IP address will be transmitted to YouTube and cookies will be installed on your computer when opening a page with embedded videos. By clicking on the video, the IP address will be transmitted to YouTube and YouTube will learn that the visitor viewed the video. The provider has no knowledge of any further possible collection or use of individual data by YouTube. For more information, please see Google's Privacy Policy: https://policies.google.com/privacy?hl=en-GB.

Microsoft Bing

This offer uses technologies of Microsoft Bing Ads which collects and saves data used to create pseudonymous usage profiles. This is a service of the Microsoft Corporation, One Microsoft Way, Redmond, WA 98052-6399, USA, that allows the provider to trace the activities of website users who reached our website through Bing Ads. If the visitor reaches our website through such an advertisement, a cookie will be installed on the user's respective computer or device. The provider integrated the Bing UET tag. This is a code through which some non-personal data on use of the website is saved through the cookie. This includes the time spent on the website, which sections of the website were accessed and through which advertisement the user reached the website. Information about your identity is not collected.

The collected information will be transferred to a Microsoft server in the US where it will be saved for up to 180 days. You may prevent the collection of the data generated by the cookie on your use of the website by disabling cookies. However, this may impair the functionality of the website.

In addition, Microsoft may track your user activity across several electronic devices through so-called cross-device tracking, which enables Microsoft to display personalised advertisements, e.g. on Microsoft websites and apps. You may disable this at http://choice.microsoft.com/en-GB/opt-out.

For more information about the analysis services of Bing, please see the website of Bing Ads (https://help.bingads.microsoft.com/#apex/3/en-GB/53056/2). For more information on privacy protection by Microsoft and Bing, please see Microsoft's Privacy Statement (https://privacy.microsoft.com/en-GB/privacystatement).

Withdrawal, changes and rectification

The user has the right to access the personal data saved on him on request and free of charge. In addition, the user has the right to rectification of inaccurate data and to blocking and deletion of his personal data, as long as there is no legal obligation to store such data.

Should you have any questions, you may contact our company at any time, e.g. at the following email address: datenschutz@herchenbach.de.

Privacy Policy changes

The provider reserves the right to update this Privacy Policy from time to time. Updates to this Privacy Policy will be published on this website. Changes are valid as soon as they are published on this website. The provider therefore recommends regularly visiting this website to keep informed about any updates.
